You are solely responsible for selecting an appropriate childcarer for your family. Tinies UK Ltd cannot be held responsible for the suitability or otherwise of a childcarer who is employed by you through an online website. Tinies UK Ltd will not accept liability for any loss, damage or inconvenience arising as a consequence of the employment of any childcarer through an online website.

Conditions applicable to everyone who registers with, visits, or uses a service via Tinies

1. The Tinies website is run and administered by Tinies UK Limited ("We" or "Us"). The Tinies website and all services and other websites available through it are referred to as the "Website" or the "Websites".

2. By using the Website or contacting us through it, the user ("You") agrees and accepts these terms and conditions. These terms and conditions shall represent a legally binding contract between You and Us.

3. Modifications and alterations to the Website
3.1. We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of the Website, the content or services or products available through it, including your access to it. Unless explicitly stated to the contrary, any new features including new content, our provision of new products or services, or resources shall be subject to these terms and conditions.
3.2. Please note that the Website may contain typographical errors or other inaccuracies.

4. Security and Data
4.1. You are solely responsible in all respects for all use of, and for protecting the confidentiality of, any email verification number and password that may be given to You or selected by You for use on the Website. You may not share these with or transfer them to any third parties. You must notify Us immediately of any unauthorised use of them or any other breach of security regarding the Website which comes to your attention.
4.2. Depending on the services You are using We might use your personal data when supplying our services, or data You have supplied about your nanny. If You have provided such data, You consent to us passing this data to the end provider of the services, such as a Tinies branch or Tinies consultant ("Tinies branch").
4.3. In addition, by supplying data about your nanny, You have obtained authorisation from your nanny to do so and We accept no liability if You have not obtained such authorisation. Any claims by the nanny will be borne by You.
4.4. The Tinies branch will not use any data supplied by You for any other purpose, although You consent to Us occasionally contacting you regarding other services that We offer.
4.5. Some data may be processed outside the EEA. Where this happens, we will ensure that it is given the same levels of protection as required under the UK Data Protection Act.

5. On Line Services including Legal Helpline
5.1. When you select a service from our Website, We will put You in touch with the appropriate Tinies branch who will use their reasonable endeavours to provide appropriate advice and carry out the services You have selected.
5.2. The information provided by our Legal Helpline is for general guidance on your legal responsibilities and is not recommendation of action to be taken. If You need specific legal advice about employment law or what action to take in a specific employment situation, please contact a solicitor. We will not accept liability for any loss, damage or inconvenience arising as a consequence of any use of the advice provided by our Legal Helpline, or the use of any information on this website. We are not responsible for claims brought by third parties arising from your use of this service.
5.3. If You are using the Reference service, please note that We cannot check the validity of a reference, or the identity of the referee. The decision to hire the nanny in question solely rests with You. We accept no liability for any loss, damage or inconvenience arising as a consequence of any reliance placed by You on the references, or as a result of You hiring the nanny based on those references.
5.4. If You are using the DBS service or Access NI services, We cannot check the validity of the nanny's identification documents. You must carry out your own checks of the nanny's documentation to satisfy yourself as to their validity.
5.5. If You are using the CV Vetting service, please note that the opinion provided in the report is the opinion of one member of Us only.  The decision to hire the nanny in question solely rests with You. We accept no liability for any loss, damage or inconvenience arising as a consequence of any reliance placed by You on the CV report, or as a result of You hiring the nanny.

6. Costs
6.1. Each of the services provided on the Website has a cost associated with it, which is advertised on the Website.  You are required to pay the services prior to any work being carried out by Us.
6.2. We reserve the right to refuse to provide the service if we discover that your payment has not cleared or has been denied or retracted.
6.3. We cannot be held responsible if there is a delay in the provision of, for example, a DBS, Access NI, or references, and the costs of those services are still to be paid by You.
6.4 As the process of providing these services starts as soon as You fill in the online request form, You hereby agree to waive your right to cancel the service You have selected within 14 days as defined under the Consumer Contracts Regulations 2013.

Force Majeure
7. We will not be liable to You by reason of any failure or delay in performing our obligations under these terms and conditions which is due to any event or occurrence that is outside our reasonable control. If We become aware of any such circumstances which give rise to any such failure or delay, or which appear likely to do so, we will contact You to notify You of the situation.
